Hello

i am on h1-b visa and my visa expires on 18 th may 2013

extension petition already filed on 23 rd april.

I have yet not received receipt from uscis

i afraid due to heavy work load if receipt not received before 18 th may, what option i have ?

If i do not receive receipt, can i legally stay till i get receipt ?

Yes, you can stay as long as the case is pending with USCIS. However, your DL might get expited. Usually DL will be issued with your earlier visa expiry date/I-94 date. If so, you need your original 797 of the renewal petition.

H1-b petition receipt

If in case, If that get denied for some reason after the expiry date and if some one is staying here waiting for the extension/transfer, what would be the status? Would that consider as a out of status?

By considering this scenario, would upgrade to PP mode help the applicant to get the result on or before the expiry date?
