  • Options after H1 EAC Receipt (I-797 C, Notice Of Action)

    Hi,

My Current Employer has filed H1B for me, and I am through H1B Cap. I have received LCA and even EAC Receipt no. (I-797 C form). Meanwhile, I am in USA on B1-B2. May I start looking for Job switch on H1B (H1B transfer) based on EAC receipt no. that I have? (there are many reasons behind this switch, which will just make this question lengthy and thus ignored)

Thanks for your time and responses.

AFAIK, You can only start working from Oct 1 2013 if your petition get approved.

    This is my opinion.

True! I can't start before 1st Oct. But, can I start looking for job now. As per my understanding, Company B is going to file an H1 based on my Receipt no. and because its already cap through, Company B may file the petition and wait for the result like in Company A. Am I correct? I don't if it is possible or not! and I don't want to breach any law, that will spoil my visa status (B1-B2).

Another company cannot use your receipt to file another petition . You would need to wait till the first petition is approved .
