  • if L1B Extension & H1B Approved with Same Employer-what to do ?

    Hi ,

    I am working for Company A on L1B[Visa Expire Date is 23rd May 2013 and i94 Expire date is 27th Feb 2016].
    My Company Started H1B 2014 cap and got receipt number waiting for further status.

    now :
    1. Can i wait for my H1B status as i am having valid L1B i94 ?
    2. Do i need to go for L1B extension?
    3. what if my L1B visa extension got approved after My H1 B approved ?
    4. Waht if H1B rejected and if i did not file for L1B extnesion



    Please guide me

    As you have a valid I-94 you are fine at present.
    1. Yes.
    2. No need. If your H1 was filed as COS and is approved, from 01-Oct-2013 you would move to H1 status and should receive a new I-94 along with the approval notice.
    3. You would move back to L1, but I doubt you can apply for extension as you have I-94 till 2016.
    4. You can stay till I-94 expiry.

    Few things:
    a. L1 + H1 together stay can at max be for 6 Years stay in US (if GC not filed timely).
    b. If you leave US you have to get a new H1 stamping done in order to return to US.
