  • Help regarding H1b Visa extension

    Greetings,

    My companies lawyer recently filed for my first H1b extension and the extension is approved. The only glitch is lawyer made a typo in the duration, so instead of filing for 3 year extension he filed for 2 year extension. So the extension duration is 2013-2015 which ideally should have been 2013-2016. Now my lawyer tells me that there is no way the duration can be changed now and i will have to file another extension in 2015.

    I checked online and found that ammendment can be filed for H1b visa if there is a material change. Does this problem i mentioned above fall under material change?

    I would really like to get the duration ammended as
    1. I would have to pay the entire process fees out of my pocket if the renewal has to be done again in 2015
    2. I will be visiting my home country for stamping in Dec 2013. Would ideally like to get a 3 year stamping rather than having to leave the country again in 2015.

    I would highly appreciate some feedback from the folks out here.

    It is entirely up to your employer and their attorney to decide this, so try to convince them if you feel like it.

    Petition filing costs should be borne by the employer and not you.
