H1B extension approval pending, H1B expires in 3 weeks Can i transfer my H1B

Hi,

Can I change my employer when my extension approval is still pending but have 3 weeks on my current H1B.

Also its been more than 2 months since I responded to RFE for my current extenstion.

Please help

Yes, since your I-94 has not expired, another employer can file for you and get it approved with I-94. But, the petition receipt date must be before your I-94 expiry date. Otherwise the new petition will be dependent on the result of extension petition.
