My wife is on H1B currently and was on maternity leave from April 15th. She had cesarean on April 26th and would continue on maternity leave until June 28th. She has leave approval (for the above mentioned period) from her employer that she would be on Maternity leave. Also if required, her employer said that they can provide a letter stating that she is on maternity leave for the specified period. Also we have a Medical certificate from my wife's physician that she has cesarean on 4/26 and would be on Maternity leave until 6/28. Also this certificate indicates that she may return to work without restrictions on 7/1/13.
Her employer does not qualify to provide FMLA. She has paystubs until April 14th. Now she would like to apply for H1 transfer immediately with a new employer. Please let me know if transfer would have any issues.
