I am on F1 visa and doing my final semester thesis and my professor informed recently that my graduation date would be Sep 2nd, 2013. My employer processed a H1B with change of status on October 1st, 2013. Only last week I applied for my OPT.
The employer takes in new employees only on Mondays so I have join before October 1st or on October 7th. But if I have to join on 7th, my company says it will have to refile the H1 petition which I don't understand. Why would my employer need to file my petition again?
If my OPT gets approved, I don't see any problem but what are the chances of my OPT getting rejected?
Are the chances of my OPT getting rejected high because I already have a valid H1B approved?
If it gets rejected, can I stay in US with H1 change of status on October 1st but join work on 7th? Why would the company have to refile?
What exactly does the employer mean by refile? Is it the whole H1 process again?
