  • H1B Transfer during CAP GAP Extension/ in October

    I am currently working for Employer A. I have 3 layers - My Employer > Vendor > End Client. My H1B is approved and will start from Oct 2013. I got CAP gap extension from my university. Now the end client is asking me to join full time. What are my options here? Can I apply for H1B transfer before October? If that is risky, can I do it immediately after my H1B status starts in October?

    Can someone help me please? I am already working for the company that has sponsored me for H1B. Do I have to work for them for at least 1 month before transferring my H1B to my end client?

      Your new employer can file their petition as a cap-exempt petition at any time. You can also join them at any time based on your cap-gap extension.

        Thanks for replying. However, it might take a while for them to open the position. By the time they open a position for me, I will be on H1B already. So the only option might be a H1B transfer. Now under these circumstances, can I go ahead with the transfer immediately in October?
