URGENT: Maintaining L1 status & Changing H1 to consular processing from COS - HELP
Hi. I searched lots of forums and found information in bits n pieces on basis of which I am framing my options:
Present situation: I am on L1b (Valid till Aug 2014 but I-94 till Dec 2015). My H1b is filed and is in "initial review" (H1 is from same company in which I am working right now on L1). H1 if filed for COS on Oct 1st.
Now I want to continue on L1b as my wife's H1 doesn't picked up in lottery. So she can continue work on L2. I am nailed down following options:
OPTION 1. Upgrade H1 to premium. After approval my company will file H1 amendment from COS to consular processing. So that i can continue wokring on L1 without going out of US.
i) Is it ok to do so ?
II) Any problem in amendment from COS to consular processing ?
III) Even if amendment is denied, my H1 approval won't be effected, right ?
IV) Can amendment be done while my H1b is in "initial review". In this way I'll save my money for H1 premium processing.
OPTION 2: After H1 is approved in Aug/Sep...do LEAPFROG. Leave US in end of Sep and come back after Oct 1st.
OPTION 3: Leave US while H1 is pending, in this way I'll abandon my COS.
Which Option is best...I prefer OPTION 1 if that's possible and changes are high for its success.
