H4 to H1 and Administrative processing while stamping in India

    Hi,

    My wife came in here in May 2012 on H4. Her H1B was filed in June 2012 and was approved by Nov 2012. We had to go to India to attend a family function in May 2013. We decided to get her H1B stamping done in Delhi embassy. The Visa interview was done on 28th May. She was NOT given 221(g) or anything, passport was collected and she was asked to pay courier charges.

    Its been over 100 days, all we hear is the processing is in status of "Administrative processing". When we called DOS, they told us that no documents or any evidence is required from either us or her employer.

    Query 1: What could be the reason for Administrative processing to take so long?
    Query 2: If we terminate this process through her employer and she goes in for H4 stamping again, will it be a problem? Is there a chance for her H4 to get stuck too?

    Finally, is there any way that we can find out at which level is her VISA stuck? (Through local authorities or congressmen or Attorney?)

    Please help. This has been crazy wait..

    I am in the same boat currently. What steps you followed . Did u bring her back on h4. Did you withdraw the h1b petition
