    Hi,

    I am an Indian citizen & I have approved H1B petition from employer A in India and the expiry date is Sept 2015. It is not stamped. It looks like there are no US opportunities with this employer so my petition will remain unused.
    Now I am joining employer B in India.
    1. Can I utilize same approved petition with employer B? I do not know petition number and I don't have any petition documents with me.
    2. If no, is there any other alternative? Like my Employer B requesting USCIS for the old petition.

    Do you have no document at all? Companies wanting to transfer your H1B would want to see some sort of communication. Also, while you work with Employer B, an Employer C with whom you are not working can also file for your H1B - you are not confined to your current employer in India for filing your H1B.

      Hi Nattybone.. Thanks for your reply!
      My current employer (Employer A- with whom I am working) has the petition documents. When I resign from this employer and join employer B; I don't think they are going to share those docs with me. Is there any way to get these docs from USCIS? If not, is there no alternate other than filing new H1 under cap?

        You will have to get at the very least the receipt number from A.
