  • H4 Questions - please help

    Hi all,

    I got married in Jan 2005. My wife got her H1B Nov 2004 and so she came to USA in H1-B visa (Feb 2005 - date of entry). Ever since, her consultant has not been able to place her and hence she has been on bench till now.

    I am now planning to change her status to H4. The questions we have are, will the consular question about her H1-B/where she worked/Produce pay stubs etc?

    Or will it be more about her husband's(me) H1B/nature of job etc?

    Please advice

    Hi Rajesh,
    Are you trying to change her status from H1B to H4 in US or are you asking about her H4 stamping at a consular post abroad?

          Hi Rajesh,
          If you are converting her status from H1B to H4 in US, you only have to send the paperwork by post and there will be no instance of having to answer questions from a consular officer. However, if her status is changed and she needs to travel out of US, then she needs a H4 stamping in her passport to re-enter US. At that time, she will have to answer a few questions about this change.
