H1B amendment

Hi,

I had my H1B filed and stamped from one of the company in fortune 20 list as i am already working for this company in india.

Now i had to travel to different location than the location filed in H1B (just change of location,nothing else ). I know that we need new LCA and H1B amendment.

My questions now :

1) Can my employer file H1B amendment once i travelled to new location ( i am thinking answer is yes but however want hear from experts)?

2) Will there be any issue at port of entry asking why are you travelling to this location than the one filed in H1B (i can't travel to my old location and travel from there because my company books tickets to new location directly)?

3) What is the best answer or proofs i can show at POE?

4) In case amendment fails (very worst scenario , 99.5 never fails because i am directly working for my employer [no client ,no vendor] , will my existing stamping and petition are still valid and can i work for old location?

Hello, Shiva.

Ofcourse the officer at the Port of Entry will ask you questions, and i am not sure how he will react. I personally feel, this is no big deal, but as per the petition, your work location is different, so an amendment is required, going by the book.

Tell me something, can you say that you are hear only for a week to train someone and then you will be flying back to the location for which your visa is filed? This is just a discussion, i am no expert on this.
