H1 Petition approved - cancelled by employer - can it be used ?

Hi ,

I got my H1 from my employer and petition was aprooved in Jan 2013.

As i couldnt travel for stamping and was not willing to go to US i asked them i will not travel .

They cancelled my H1 petition in March 2013.

Now things have changed and i can travel to US on H1 for long term.

Can the same H1 petition be opened and used again ??

Why did they cancel the petition as usually employers dont cancel H1 ?

Hello, Madhu.

Yes, either the same employer or a new employer could file a petition for you and use the same visa. It can be used.

Employers are not permitted to keep open visas if the candidate is not working with them. So, they revoke visas in such scenarios.
