    Hi,
    I have a Valid VISA till 2016. I have got new Opportunity from New Employer. Currently my wife is pregnant. My new employer processing H1B transfer on regular process. They are not willing to do Premium process as they had 98% success rate in VISA transfer. However I am worrying about in case if it gets rejected. At that time my wife will reach a situation where she can not travel. In such situations is there any chance that I can extend our stay in USA?

          Hello, Ramesh.

          Are you ok switching to F1 (Student) visa? When the time comes, you could enroll in a University and switch to F1. That would give you extended stay. But, you will have to do this before H1B decision comes.

            I would suggest you to pay for the premium processing as it is legal (if I am not wrong) to do so, get the result in 15 days and decide based on the transfer result. It is not advisable to work based on the receipt number as you would be out of status if the transfer petition get rejected in anyways.

            This is my opinion..
