    Hello,
    I am in need of your help regarding my wife's H-4 visa stamping.

    She went to Interview on 20 Spet and were asked a few questions, She has used a translator in order to answer the questions.

    She forgot to take the whole entire wedding album and form 221(g) mentions that Photo Album and a letters from the company is required.

    I currently work with HSBC Bank and I have my H-1 visa stamped successfully from Canada.I got married on 2 June and I joined HSBC on 22 June. I have sent my pay stubs and also W-2 forms of previous years, I have also send a letter of employment continuation but i don't understand what kind of letter they are asking for.

    my questions and concerns are as follows:
    1. Does having translator affects the visa decision.
    2. Do they need or check other documents for the second Interview.
    3.What kind of format i should used to address the Us consulate.
    4.I haven't filed the tax return form in last year whether that will affect my wif'e visa.

    Any help and advice is greatly appreciated.

    Hi Sachin,

    Having translator shouldn't effect the interview. There is nothing wrong in having a translator. So don't worry about that.

    Its better to carry all the documents even for the second time along with the documents they asked in the query letter. Don't forget to take the wedding album and marriage registration certificate. Please take no more than 30 wedding photos. No need to show them the entire wedding album.

    Also you should take a letter from your employer (Which your H1B visa holds) stating your continuation of employment. If you are a fulltime employee of HSBC bank you should take that letter from HSBC. If you are in consulting field you should take that letter from both your employer and also from HSBC.

    Other thing is you said you have sent all W2 forms and 1040 tax returns of the previous years. But at the end you mentioned that you haven't filed the tax returns for the last year. How is that possible? If you haven't filed the tax for 2004, you should show them the pay stubs for full calendar year.

      Thanks for your help and advice.

      I haven't send the 1040 form and i haven't filled the tax return form for the last year as i have just worked for 2 months in year 2004 and rest of the time i was looking for JOB(OPT period).I thought that i will filed the tax return for 2004 and 2005 at the same time.

      I need to ask a couple of questions and i will be very grateful if you can advice me.

      In the refusal form they have not check any boxes and they have mentioned in the Other category that Wedding Album and letter from HSBC bank is required.

      I have got a letter from HSBC bank as a full time employee and i have also send the letter to my wife.Along with that i have send all the W-2 forms and pay stubs for the last year and the current year.

      my only concern is that during the second interview whether they ask for another documents or they just want the documnets metioned in the refusal action form.( ie Wedding album and letter from HSBC).

      The consulate haven't given my wife passport and they have withheld the passport with them, Is this a normal process.


      Please help.

        Hi Sachin,

        I looked into your previous posting. That says the consulate people asked to include your wife's name either in the offer letter or in the employment verification letter. This looks very starnge to me and also simply this is NOT POSSIBLE.

        I am assuming that the letter asked this time might be the same letter (Letter including your wife's name). So you can write to consulate saying that this is not possible anywhere in the world. I guess since your wife did not produce the wedding photos, they are having a doubt on your marriage and they are asking such letter.

        Producing wedding photos might solve your problem and it's a good idea to caryy all the documents even for the second time or third time. There is a chance that the consular officer might want to see them again.

          Hi ronin,
          thats absolutely true that its just impossible to have my wife name on my offer letter or on continuation letter, but i have managed to get a letter from HR and also have my wife name mentioned on it, i have also included my marriage date on it.

          I am really not sure about this query as i have searched all the forum for this kind of query, but i couldn't see any single query about wife's name in offer letter.

          My wife is going to carry all the documnets , the only fear i have is that i haven't filed tax return form for the last year and this is really scaring me.

          I greatly appreciate for your help and advice.

            Sachin,

            Glad that you got the letter from your HR. I hope you showed them a copy of 221(g). Also make sure that they may get call anytime once your wife produce that letter. Another most important thing is to produce wedding photos. Hope your wife won't forget them this time.

            Regarding 2004 tax returns submission, it's not at all a problem if you took the extention from IRS. Generally every one in US has to pay the tax on or before end of April. Other wise they should take the extention from IRS to pay tax before some time in Oct. (Iam not sure about this).

            So if you have that extention copy fax it to your wife.

              Hello Ronin,
              I have fax my extension form to my wife and I am also attaching the 221(g) form.

              The Consulate have only marked 221(g) box and in that section they have mentioned Other documents, My understanding is that if they have not checked other boxes in the 221(g) section then they will be primarliy interested in the document they mentioned in other section and not all the points under 221(g) section.

              I am attaching the 221(g) form which my wife got from US consulate.

              please advice.
