  • H1B expired- no old petition-cap exempted ?

    Hi all, have a concern.

    I got H1B by company A on Sep 2011 for 2 yrs. i went US and returned back. When i resigned company A on Aug 2013, they have taken my petition document.
    now, if i apply for H1B through company B, will it be cap exempted as im worried my petition document was taken...

    Hello, Jskobs.

    You will cap exempt upto 6 years from the last time you were on H1B status. You will need some reference number to revive your H1B (you might switch to a new employer and want to use this visa). As long as you have some reference number or copy of the approval, you will be able to revive it in the future. No worries.
