I am in a big messy situation. My wife is 7 months pregnant and her L1B RFE response is in review. I am in H1B (through master's category) and not stamped yet.
As her I-94 has expired, we are thinking of going to India and get her back in H4 as L1 extension is most likely to be rejected. I have the following questions:
1) For her H4, do I need any kind of petition applied from my employer ? Or is it just adding dependent in my H1B stamping interview ?
2) When I go for the interview, does her pregnancy affect our chances of getting approved or rejected ?
