H1 B cap exempt query

I filed H1 in 2008and I got 221g . After that employer didn't responded it. Am I eligible for cap exempt ?

One should be in H1 B status to use exempt within 6 years ? Pleas help me on this

If you were picked up in the draw for 2008, you should be able to file, and file cap exempt, till 2014.
