H1B Transfer while my extension is in RFE response review

Hi -

My H1B Visa and I94 expired on 06/30/2013. My Current employer has filed my extension on April 2013 and it went into RFE Status. RFE response was given on 11/04/2013 and the Status is now RFE response Review as of 11/05/2013. [Normal Processing, No Premium Processing done]

I have a job offer with a company now, they are ready to process my H1B transfer in Premium Processing.


Now, what are the issues I could face if I go ahead with the H1B Visa transfer by the new company?? Have anybody here done that already?
I am just confused as I read in this forum too that the Current Company's filed Visa extension should get approved first and then only I should be able to proceed with the Visa transfer. Is that true? I also dont understand "Out of Status" situation. Could anyone explain please.

Hi - Did you received any concrete response, I have the same issue, only different is that I just received and RFE and I haven't submitted the RFE response yet. Can the visa transfer be initiated or should we file a fresh H1-B ? Please suggest
