  • Start date changed on H1B Amendment. Going for Stamping soon.

    Hello,

My employer filed for H1B amendment and it got approved but the start date in new I797A changed from 10/01/2013 to 11/05/2013.

Here is my case: I was working on OPT which is valid till July 2014. In April my employer filed for H1B and it got approved for a period of 10/01/2013 to 09/30/2014. But in May my client location changed and I started working on the new client location from May 2013. My H1B which was filed got approved in August 2013 and in Oct 2013 my employer filed for H1B Amendment which got approved on Nov 7th.

But the start date on new I797A changed from 10/1/2013 to 11/05/2013 and the end date remained same. I will be going to India in Dec and I am already in the process of booking dates for interview. Also my wife's H4 visa has dates of 10/01/2013 to 11/05/2013.

So now we both have different dates on our approval notice. Will there be any problem during Visa Stamping because of this, "start date" changes? My employer attorney says if USCIS has changed the dates then they know what they are doing so no need to worry. But I still need to check if that is fine or if that is an error.

    Thank you.
