  • H1 transfer with old valid I797

    Hi ,

    I am currently on H1b since June2011(valid till June 2014). My current employer has already applied for extension since they changed my position and has received acknolwedgment from USCIS.
    I have an offer from another company who will be filing H1b around December or January. Since the offer was made prior to H1b extension application by current employer I have provided them with my old I797 and other documents. I have the following doubts:

    1. If I receive new I797 before the H1b has been filed by new employer will it affect my application or it is fine if they file with old I797?
    2. Should I give the new employer information about my receipt number of h1b extension or it is not required?

    I feel it does not matter much. Your visa category is same and this is just an acknowledgement. You could share the acknowledgement, if you like. The USCIS will be able to link your applications, so no worry about that, i feel. Personal Opinion.

      Thank you so much for sharing your opinion. I agree with you that I should share the acknowledgment with new employer to be on the safe side.
