  • Cancellation of H1B Visa stamping

    I am in India currently. I have a valid H1B with Company A and also have a valid visa stamping. I now have an opportunity with Company B who is doing a new I797 for me through consular notification. I have been informed by Company B's attorney that I can travel on my existing visa with the new I797. I have 2 questions:
    1. Is this a valid process?
    2. Does Company A have the right to cancel my existing visa stamping? What are the chances that they will cancel my visa?

    1. Yes and it is a valid process.

    2. They do not any rights to cancel your visa stamped on the passport however they can revoke your petition. It does not matter to you though.

    3. Ask your company B to process your transfer in premium mode, and get the petition approved. Submit your resignation with company A and then travel using your new approved petition with the existing visa stamped on the passport (yes, you can still travel though your visa has your old company name on it)

    This is my opinion.
