  • H1B Visa Transfer to New companies

    Hi Senior Members,

    Here is my situation.

    I got an offer in Company A and accepted the offer and Company A has initiated the transfer(Got the EAC receipt number for Premium transfer. Yet to be approved).
    I attended another interview with Company B which is also willing to offer me a good pay than Company A.
    Now, Can I have Company B transfer my visa again?. What options do I have to take up Comapany B's offer?
    What are the challenges/difficulties/risks? Please elaborate.

    B can certainly file a cap-exempt petition for you. It is totally up to you which company you want to join.

      Need clairification H1B exempt - 2014

      Hi,

      I got my H1B approved in 2006 and was valid till 2008 end through employer A. I got it approved through Chennai consulate in 2006. However i did not travel to US, i'm i cap exempt.
      Earlier i travelled to US from 1998 -2000 on H1B and L1 from 2003-2004.

      Following are my queries:

      I'm i cap exempt now for 2014 through another consultant - B?
      Can i avail the unutilized period (6- period of my stay in US (98-2000+ 2003-2004) which is close to 2 years now?

      Need guidance on the same.

          Yes, it was a new petition in 2006. Do i stand a chance for cap exempt?
