Expired Approved Unstamped H1B Visa

I have approved H1B petition(I-796C Notice of Action) which was valid from October 1,2007 to September 23,2010. I have not got it stamped. My queries are:

1. Is it CAP-exempt as of now?
2. If it is CAP-exempt, can it be processed or is there a requirement of new application.
3. I it is not CAP exempt, is there any other way to get the H1B visa now.

3. I it is not CAP exempt, is there any other way to get the H1B visa now.
