I am in a critical situation so request for your kind reply on this thread...
I am left with 16 months on my H1 B (6 years Cap). My current employer A is not sponsoring for Green card so am looking for new employment who can sponsor for my GC. How ever my current H1 is expiring on Feb 20th 2014. So my current employer A filed for extension on Dec 20th 2013 and its in " Initial Review" status. I have few interviews lined up in Jan 2014 so I may fall into any of the below scenarios. Could you please provide your valuable inputs on this ?
1) Suppose I Got offer from Employer B on Jan 20th and B filed for Visa transfer in premium while extension from Employer A is pending ? Does this cause any Issue ? Will it cause any RFE to Employer A ? My understanding is both petitions can run in parallel and they are independent as I 94 is valid till feb 20th.
2) Suppose I got offer from Employer B on Feb 15th , and B filed for Visa transfer in premium while extension from Employer A is pending ? My I94 expired on feb 20th and both the visas from A and B are not approved by 20th . In this case when can I start working for Employer B . Does the Visa transfer from B is dependent on extension approval from A ? Will I go out of status any time ?
3) Suppose I got offer from Employer B on Feb 25th and B filed visa transfer in premium while extension from Employer A is pending ? As per my understanding in this case visa transfer approval from B is dependent on Visa extension approval from A . This seems to be a risky option ...
What are the chances of RFE to either Employer A or B due to multiple Visa petitions in all the three scenarios.. Please advise
