I was working with company A for over 2 years and my H1 is valid till 09/14. However I switched jobs and transferred my visa to company B starting 01/03/14. Last week they had to let me go because of a merger but I'll be on their payroll till 01/31/14. Now my old employer, company A is willing to take me back and as per their attorney I do not need to do anything but I've been reading about a "possible" requirement from Dept. of labor for old employer to backpay me but even in that case I cannot be getting paid from 2 sources since company A has me on their payroll during this period from 01/03 - 01/31. Could you please advise if joining my old company without they backpaying me would be a good idea? Appreciate the help.

Would really appreciate if someone with a similar experience or anyone with with any knowledge of such scenario could shed some light. It's very urgent.
