H1B stamping with a pending DUI case

I was arrested for a DUI on Jan 4 2014. My first court hearing is on Feb-18-2014.

I attended visa stamping interview on Jan 30. From what I read online, applicants with a DUI will be given a 221g and will be referred to panel physician. And the whole process usually takes 3-weeks to 2-months.

But during my interview, VO said I will be staying here for a while (approx. 1 year). Does VO control how much time does it take for an application to be processed.

I was under impression that these kinds of applications (221g with dui) usually take 3 weeks - 2months.
