  • Filing H1B by two Employer for a same person

    I have my H1b 2014 is filing by two employer. I just wanted to know it is not illegal.

    1) Company "A" and Company "B" filing H1B for "Person"
    2) If one get selected other will automatically rejected?
    3) If both approved (or one approved and one identified as duplicate) will the employer be charged by USCIS?

    Please help me out with these questions. Thanks in advance!!

    1. Yes no issues.
    2. No.
    3. What do you mean by charged by USCIS? Both the petitions can be approved, and the charges would be have to paid, though its obvious you cna join only one employer.

    This is my opinion not legal advice.

      Thanks, Third question was->
      If "A" and "B" paid my H1B cost and A got selected ( in fact i chose to go with). Will "B" get the money back paid for the visa?

      Thanks in advance!

        No. Plus all the legal cost would also be wasted.
