I signed a contract and came to US thru XYZ consulting company. XYZ did not pay me when I joined them in US (bench period). XYZ also asked me to sign a new contract (and I signed) in which they included additional penalty.

Can they sue me if I leave XYZ even though XYZ don't have any project for me?

Please keep in mind that whatever the period you remain on bench/without pay while working for any US Co. will have to explained for all future stampings at any consulate abroad.
