New H1 based on an expired H1 approval

Hello,

My scenario is as follows:

I have my H1 approval which was from 2007 Oct (valid till 2010 Oct) and I have never entered into USA by using this H1 approval. But now I have got a project offer from another company, Can the previous approval be used and can I have my H1 transfer done successfully?

Kavithan, What did you end up doing finally? Did you apply?

I am in the exact same position as you. Had an approval, it expired and I never used it but have an offer now and would like to use it.

My employer filed for H1 transfer using that approval in premium processing but I have received an RFE. Don't know what is going to happen from here.

Please share your experience.
