  • Original I797 Form

    Hi Folks

    I have a valid H1B stamped on my passport in the name of my previous employer, when i had left the company, i had to surrender all the original I797 and I29 Form. My current employer who is a staffing company is asking for original I797 and willing to send me to US with a new project invite letter on the existing petitioner. Do i need to have the original I797 form when i enter US ? or a copy of the same is fine. I have my H1B [from previous employer] visa stamped on my passport.

    What do you mean new project on existing petitioner? They cannot send you on a old petition but the current employer can file a new cap exempt petition with immediate start date (if earlier H1 was approved within last 6 Years) and if approved, you would be getting a new I797 which you can use to travel to US.
