  • Impact on resigning the current employment before the H1b interview?

    I am a Chinese resident and currently working in company A in China. I've accepted an offer from a company B in the USA and now I plan to quit the current job for several "gap months" and refreshing myself up. Here is the situation and my question:

    Situation:
    1. I submitted my current job information to company B for background checking.
    2. I do not and did not own any American working visa before so I will join the 2015 H1b cap lottery.
    3. My visa agent has a copy of my up-to-date resume on which I state the current employment spans from " YYYY " to "Present".

    Question:
    Is it OK to quit the current job? The employment spanning to "Present" when at the visa interview would be inappropriate if I did. Does the H1b visa interview(if I managed to get one slot in the lottery afterwards) queries on my current employer in China and it would have a bad impact if recently quit a job?

    I was kinda worrying if any information or document from my current employer would be required for the H1b visa.

    Any advise would be much appreciated.

      Thanks for your reply. My start date with company B is Oct. 2014 right after the next financial year, while I received their offer in Sept. 2013.

      I just graduated at July last year. The employment with A is really just a temp job for my gap year.

        You can quit the current job once your petition has been submitted. I don't think there will be any issues when you appear for visa interview as long as you have provided the correct information when you are applying.

        This is my opinion.

          Seems about right. That's a good point. I will consider quitting this job in two months when the petition is submitted.
