    Hi,

    My H1B extension was filed on Jun 25th 2013 at Vermont service center, visa status moved to RFE on Jan 21st 2014. There is some confusion in petition address and i dint get RFE notice till now. We have filed a case to send notice again. I am yet to receive my RFE petition notice, might take 2 to 3 weeks to receive notice now. I want to know the notice period end date and the last date to submit RFE document at USCIS. Someone Please clarify.

    Worst part is My Visa got expired on 30th Sep 2013. its been almost 5 months. I have very crunch time for my processing. I have already planned for premium but cant do until i receive my notice.

    You should have converted this to premium before your I 94 expiry. To answer your question, hope you would have 90 days to respond to RFE. Check the RFE notice to confirm.

    I am not trying to scare you but just want to let you know the facts. Now if your petition denied in any chance (hope it will not) your stay will be considered as illegal from the day your I 94 expired and not from the denial date. There is a 240 days rule wherein if someone stays illegally beyond 240 days, there will be 3 years ban. So act fast and try to get the result ASAP. Wishing you best luck.
