Travel to India before H1 transfer is filed???

I was working for company A and have quit my job in Jan 2014. I-94 is valid till May 2014.

I found job at company B who is filing for H1 in next couple of days in premium processing. Can I travel to India before they file?

This company attorney said it is ok. Some are suggesting it is not good.

Please provide your suggestions.

You are out of Status and most likely your H1 transfer will not be approved with a new I-94 hence you anyhow would have to leave US.

When is your visa expiring?
