    Hi

    I have a valid H1B petition through my current employer. The Petition is approved and valid till next 2 Years.
    I am not able to find a suitable US opportunity through my employer as of today. My H1b Visa is not yet stamped on my passport.
    My Husband is already in US on his own H1B through his employer.

    My Queries are

    1. Can I file a H4 based on my husband H1b Visa and travel to US ?
    2. Will this H4 may have any impact on my H1b petition(not stamped). ?
    3. If I am in US on my new H4 and If I get some opportunity with my own employer can I work there with my own H1b(through the same employer)?

    Can someone help me and clarify on these points.???

    Yes, You can do that.

    1. Get your h4 stamped, travel to the US on your H4.
    2. Find the new employer who can transfer your petition and apply COS from H4 to H1. Once it is approved, you can start to work for that employer.

      Thanks kadkhiq81 for the replies.
      My other questions are still unanswered.

      If I leave my current employer and travel on H4(based on my husbands H1b). Will it impact my own current H1b petition which is not stamped.
      Can My current employer revoke the H1b petition if I leave the current employer and go on H4 ?
      Is it not a risk as my H1b stamped and I only have approved I797 and I129 petition documents .

      How is the two scenarios different in such a case
      1. H1b Petition approved , Visa not stamped - and leave the employer and travel on H4
      2. H1b Petition approved and H1b Visa stamped - and leave the employer and travel on H4 .

        It does not matter to you even if the revoke your petition and it will not impact your H4 or H1 transfer.

        An approved petition is valid for 6 years.

        This is my opinion.
