I94 Issue
My wife is on H4 visa. I recently extended both my H1B and her H4. So with new extension was Approved on 21st Jan 2014 and effective start date from Mar 20 2014 - Mar 19 2017.
Then my wife travelled out of US on Feb 3rd 2014 and was positive to enter back with her old visa that is expiring on Mar 19 2014. And during reentry to US on Mar 7th 2014, CBP officer despite looking at her extended H4 petition with I-94 number expiring on 19th Mar 2017, issued her a new I-94 that expires on Mar 19 2014.
I went to CBP office(on 18th march 2014), The officer told me the I94 on I797A is legal science it will be valid in 2 days(the next day of current I94 expires).
My attorney says last i94 number which POE given is the valid I94? is it true?
Last action rule is depend on effective date or issued date?
