H1 B Visa Transfer

Hi,

I have a query on H1 B visa transfer. Can someone please clarify.

I have obtained H1 B visa in Oct,2010 from employer A. I worked with the employer A till Feb, 2013. and transferred my visa to an employer B. I worked with him till May,2013. I have moved back to India working for another employer. My i797B is valid through Feb,2015. H1B stamping in my passport got expired.

I want to start working in the USA again.

Can I transfer my H1B by staying in India, to another employer who is willing to transfer?
I have checked the i797B status by providing the case number, which says it got revoked - Will it impact the transferring process?

Yes, any willing employer can file a Cap Exempt H1 petition quoting the receipt number of your earlier approved H1 petition. Once the Cap Exempt petition is approved, you can take that and attend H1 stamping.

Petition being revoked by earlier employer doesnt prevent this.

i am working for a company A, some consultancy said they will do GC from me so, they applied for my H1B transfer, i kept paper now my employer saying that he will do GC


so my question is can i cancel my H1B transfer and stay with present employer. please some one help me with this. i am in confusion.
