H1 to H4 pending to H1b

Hi I am on H1b and last day of work is May 15 as company is going out of business.

Spouse is on H4 and has filed H1b for year 2015 (Got receipt number).

I can add my name under spouse's H1b which is pending then find a job and apply again H1b?

Your spouse, if H1 approved, would move to H1 only from 01-Oct-2014. Till 30-Sep-2014 she has to maintain valid H4 status , for that, till 30-Sep-2014 you have to maintain valid H1 status.

You wouldnt be able to move to H4 till spouse's H1 start date.

Advisable to find another employer as soon as possible to continue maintaining valid H1 and H4 status for you and your spouse respectively.
