  • Transfer within same company from US to India

    Hi,

I had been working in US on H1-B Visa from October 2010 to February 2014. I needed to take a transfer to India within the same company and I'm working in India for the last two months. What will happen to my H1-B visa? Will it be cancelled by now?
Also, if I get transferred back within the same company will the company need to apply for a new H1B visa or will the visa be related to my first one?

    Thanks in advance!

It depends. Your petition is likely to get revoked once your employer notifies USCIS that you are no longer working in the US. If they decide to relocate you to the US again in the future, they might need to submit a new petition; but this one might be easier to file (being cap exempt), in which case you could use the time remaining on your old petition.
