  • H1B canceling and H4 travelling after H1 cancelled

I have following situation and I looking for desparate help

I am going to join company B (new H1 from company B) from 16th June 2014. My wife has H4 (on my H1 from company A) visa stamped till Jul 19th 2014. She has plan to travel USA on July 2nd. I have following questions

    1. Can she travel on company A H4 on July 2? I will stop working for company A from Jun 16th so there is strong probability that company A will cancel my H1. Can my wife travel even after my H1 is canceled?
    2. If she cant travel on company A H4, do we need to do stamping from company B? If yes, this process will take lot of time as I will not be having sufficient paystubs from company B till July 2nd.

    What will by my options?

    1. Yes she can travel. But to travel back into US, she would need your H1 approved petition of company B. Also, if she is planning to travel into US after July 19th 2014 she would first need ot get a new visa stamp.
    2. Read above. For attending visa stamping she needs the approved H1B petition for you for employer B.

This is my opinion not legal advice.
