URGENT question regarding H1B transfer
I have a question regarding H1B transfer and I need to make a decision in the next couple of days regarding it. I graduated in December and my OPT started in February. I received a job offer from Company X back in February, they applied for H1B for me in April and it was approved. My start date with X is in June.
So meanwhile I started working as an intern for another company (Y) on my OPT. I now got an offer from Y also. Could I accept the offer from company Y and transfer H1B to them (file a new petition) although I never started working for X?
Reading online, I know that if you work for a company and you get a new offer you can transfer H1B (file a new petition but not wait for cap) and there should be no issues but in my case I never started my work with X.
I've looked online a lot and couldn't get my answer. A friend of mine told me that I need to work at least 3 months for X before I can transfer H1B!
Any input would be greatly appreciated.
