  • Pls read this....H4 to H1

    Hi friends,

    Pls read thru my situation.

My H4 visa and I-94 got expired in FEB 2005. Before it got expired I filed for my H4 extension. 5 months later I filed my H1B. Then my husband transfered his job to a different company and his previous company has filed for his H1B cancelation thereby my H4 extension which was pending would be canceled too. So, right now I don't have valid H4 or I-94 but I've filed for H1B.

Is it legal for me to stay here at this situation?

    Pls reply.
    Thanks

    Sathya

hope none of the INS guys were looking here...
    just kidding...

First of all..whats the status of H1/I-94 your husband now..??
You said your I-94 and H4 got expired in Feb 2005. Usually H4 expiration date depends on H1 expiration date. So, I assume that your husband's H1 and I-94 also got expired in Feb 2005. Didn't he applied for extension at that time? You didn't tell when your husband switched the job.
Just filing a H1 will not allow you to stay here.
