  • URGENT: H1B transfer within short duration

    Hi All,

    I have H1B visa and arrived USA Last week from my current company 'x', I will be working here for Exactly 3 Months with my Current Employer 'x'.
    My Travel Plan is to go back my country after completing 3 Months and In USA It won't get extended any more with current employer,
    I am planing to do H1B transfer with company 'y'. Please help me with the below queries

    1) How Many Minimum Pay stubs(ADB payroll) from current company I need to show for H1B transfer ?
    2) Due to the limited time I might not be able to serve the Notice period with current Employer 'x', Can Current company will make any problem using my SSN or Blacklisting my records?
    3) If My H1B transfer is approved within 2 Months, can I continue working in Current company 'x' for 1 more month notice and then can I join new company.. is it possible ?
    4) please let me know the risks involved due to the short schedules...

    1. One needs to have valid pay stubs for all the while one is in US to demonstrate valid H1 status. Technically, if you are outside US, you dont need a paystub to show your H1, you need approval notice to prove your cap exemption.
    2. Dont see how that will impact your immigration records. They cant do anything with your SSN.
    3. Yes, while outside US what you do is least of USCIS's concern (as long a sits legal :-) ).
    4. Dont see any based on what you have mentioned.

      As I am Already In USA,
      -> How many Minimum pay subs are required for H1B transfer without having any risk of getting RFE in H1B transfer?

        There is no concept of minimum, advisable to have valid paystub for the entire duration you are in H1 status.

          I mean, As I don't have a much time so can I apply the H1B transfer after getting my First Paystub itself?

            Technically you can. But not advisable to join next employer without first getting the transfer approved.
