  • Is it possible for the current employer to interrupt H1B transfer?

    Hi,

I currently hold H1B visa and another company is initiating H1B transfer for me. I don't have any legal agreements with the current employer regarding resignation notice however in order to be professional I want to give them a notice about me terminating my employment in the near future.

Assuming the worst case scenario of them becoming unhappy and trying to terminate or interrupt H1b transfer process, what is the best time (if any) to give such a notice? Is it safe to give such a notice after the documents are filed to USCIS? Or after USCIS receives them and sends back receipt (i.e. while the case is in the 'Initial Review' phase)? Or is there no good time for that and to be safe I should wait till the very final approval and then terminate my employment without notice? (after visa is approved, the new company is expecting me to start ASAP since all these visa related procedures are already taking very long).

Also I know that the new company has premium processing with USCIS so approval shouldn't take long.
