I'm going to India and have to get my H1 visa renewed. Would like to know if I'm eligible for interview waiver program.
Quick summary on my status:
So far I have been issued visa 3 times from 3 different locations
1) My Recent Visa was issued in Toronto Canada on 22nd Feb 2012 and expired on Jan 31 2014 with Current Employer: Emp-A
2) Prior visa was issued in Hyderabad, India on 28th July 2010 for different Employer: Emp-B
3) The one before that from Belgium in 2007
I'm planning to renew visa with current employer(Emp-A) and I have question on Point 2 of the eligibility criteria.
Below is the IWP criteria posted in https://cgifederal.secure.force.com/applicanthome
You would like to renew your visa and all of the below situations are applicable:
The previous U.S. visa you have/had is in the same visa class as the one you wish to renew. -> Yes H1B
Your previous visa was issued in India. -> No/Yes My most recent visa is issued in Canada but one of my previous visas are from India. The term "Previous" means Most recent here? They have also used the term "Most Recent Visa" in below points so not sure if I'm over thinking.
You have no refusals for a visa in any category after your most recent visa issuance. -> Yes, No refusals
Your most recent visa (in the same visa class for which you are applying) was issued on or after your 14th birthday. -> Yes H1 B
If you are applying for B1/B2, C1/D, F or J visa, your prior visa in the same classification is still valid or expired within last 48 months -> NA
Or
If you are applying for H or L (individual) visa, your prior visa in the same classification with the same petitioner is still valid or expired within the last 12 months. Note: Blanket L visa does not qualify. -> Yes Same employer as previous one
Your most recent visa (in the same visa class for which you are applying) was not lost or stolen -> Yes Not stolen
My prior visa is not annotated "Clearance Received" -> Yes, was not annotated "Clearance Received"
One of the two situations apply:
You received your visa after January 1, 2004. -> NA
You qualify for Interview Waiver Program but you still have to go to OFC for fingerprinting[1].
You received your visa after November 1, 2008. -> Yes, I have received visa twice after 2008
You qualify for Interview Waiver Program "Drop box" program. You don't need to visit OFC for fingerprinting.
