  • H1 visa rejected petition Documents

Hi, My company filed my H1 visa this year which did not get selected in the lottery (I assume). They did not inform me about the rejection package until recently when I kept nagging my manager. Now, they are not giving me my copy of my petition and the rejection notice. I have been asking it to the manager for several weeks, and she continues to say that she has emailed the HR regarding it. My questions here are,
    1. Would there be any problem if I don't have the copy of the rejection letter from USCIS, and the copy of my filed petition next year when some other employer files my visa?
    2. Who is responsible for providing me the the copy of the petition and the rejection notice, the employer or the attorney?
    3. What should I do in case they don't give me the copy at all? Because I cannot work anymore with this company as I was on OPT and it gets over on August 15th.

    1. No.
    2. USCIS would send it to the attorney, the attorney would send it to the employer. Its not mandatory for the employer to provide it to you.
    3. Are you eligible for OPT extension, if yes you should apply for it. If not, try for job in cap exempt H1 category such as jobs in research institutes, Universities, Community colleges, non profit organizations etc. If not, then see if it is possible for doing further studies.
If none of these options seem feasible , you should probably plan to leave US.

This is my opinion not legal advice.
