  • DOB discrepancy in I-797 doc

    Hi

    Today I got my H1B doc package & I found DOB discrepancy in I-797, Notice of action doc.
    Mentioned DOB is: 4/29 but my actual DOB is: 4/22. Not sure but seems like they got confused with the receipt date which is: 4/29/2014.
    Can I go for Visa interview with this discrepancy? Experts please advise the way forward.

    Hi,
    My sponsor company lawyer had created service request to USCIS for DOB correction & USCIS told us to expect a reply by end of this month.
    Does anyone has some experience/knowledge of this matter? Does USCIS replies on time or it will take forever?

    Please advise.

      How big is the date discrepancy?

      If only a few days or months, it's not something that will cause problems later, if there are additional forms to fill out where you have a chance to correct it routinely..

      How did the error occur?

      If reported correctly to USCIS, a confirming I-797 isusually generated in 3 or 4 weeks, for pending petition paperwork.

        Thanks for your reply Ray B.
        It's just 7 days gap in DOB. I checked from my side there wasn't any mistake in the docs I provided them for my H1B. Even the lawyer confirmed me that they provided correct submitted proper docs to USCIS for the same, There may be some mistake from USCIS side in I797B, even though my I129S form has correct DOB mentioned in it. Is it the lawyer who will need to fill additional form on my behalf? The lawyer already sent me the request ID provided by USCIS for this correction case.

          If USCIS is requesting a formal correction, it doesn't matter who submits it, you or the attorney. In my opinion, if he has the correct data and is representing you, he should handle this.

            It got rectified last week (in just 2 weeks!!) & I got a new amended I-797 notice of action.
