Hi
I am in a situation, where My Visa expired and my H1 extinction is under process, I got receipt(1-797) number for it too. I am currently in USA.
My current employer is trying to send the documents for the RFE as of now, but in mean time I got better opportunity in other company where I need to do H1 transfer/new petition with them. But they have concerns if they do it now with premium/regular process will it cause RFE again and how to handle or will it cause me going out of status.
Please suggest me what to do.
