  • H4 to H1

    I was working in US with H1B from 2010 to 2012 and then i quit. I travelled to India and came back to US in H4. Now I am planing to search for jobs and start working again in US. Will my H1 still be active? How should i start this process? Please help me.

    First find an employer willing to hire you on H1 for your skill set, once you have a job offer in hand, using the earlier approved H1 petition, the employer can file what is called a cap exempt H1 as a H4 to H1 Change Of Status for you by virtue of the fact that you were cap counted in last 6 Years and have not exhausted the 6 Year H1 limitation. Once this cap exempt petition is approved you can start working for the employer.
